This patent infringement lawsuit between Apple and Samsung has gone on for a couple of years now, Apple initially won a substantial damages award which was appealed by Samsung and reduced in subsequent proceedings. However the matter is far from over, Apple and Samsung are about to head to the second retrial in this damages case and the judge wants both companies to sort out the matter quickly.
Judge Lucy Koh is going to preside over the second Apple vs Samsung damages retrial, proceedings are set to start in either March or April 2016. Samsung’s request for a new hearing on the first patent trial has already been turned down and while the company has filed its case before the Supreme Court it can’t be said for sure right now if the apex court will take up the matter. The second retrial is going to focus on calculating the proper damages on the five Samsung devices that were originally found to have infringed on Apple’s patents, the products have since been discontinued and the initial damages award has been reduced from $1.05 billion to $548 million.
The judge doesn’t want this matter to drag on, the court is not going to allow both sides to bring new theories and only one week has been scheduled for the retrial which includes time for opening and closing statements. Apple has moved a request for a partial final judgement on the other hand Samsung has moved to stay the trial proceedings because of the recent invalidation of an Apple patent by the USPTO. In short: this is far from over.
